Minimum Wage of  District 2012 (UMK 2012) in Banten province still remains a problem. This is because the decision of the Governor of Banten Sectoral Minimum Wage (UMSP) Tangerang City and Tangerang Regency is interpreted incorrectly by the Head of Department of Labor City of Tangerang, especially in the sectors Textiles and textile products (TPT).

 

Earlier in the year 2011 amounting UMK Tangerang City to Rp. 1.29 million, - and in 2012 according to Decree of the Governor of Banten Fixing Minimum Wage No.561/Kep.886-Huk/2011 District / City of Banten Province Year 2012 stipulated that the MSE of Rp.1.381.000 Tangerang City, -. This decision is revised by Governor's Banten Decree No. 561/Kep.1-Huk/2012 on Amendment of Banten Governor Decree Fixing Minimum Wage No.561/Kep.886-Huk/2011 District / City of Banten Province 2012 so that the UMK City Tanggerang to Rp. 1.52915 million, -. After a case of refusal by some sectors of the business through the Association of Indonesia (APINDO) all employers eventually agreed to accept the UMK Tanggerang City of Rp.1.529.150, -.

 

But with the Governor of Jakarta Decree No. 561/Kep-2-Huk/2012 of Sectoral Minimum Wage Tangerang City and Tangerang Regency of the minimum wage set some sectors are higher than other in Tangerang City. Rejection of Tangerang City UMSP by Indonesian Synthetic Fiber Producers Association (APSyFI) for Surat City Manpower Tanggerang UMSP considered one explain this to the union that requires a higher minimum wage.

 

Secretary-General APSyFI, Redma Wirawasta Gita says that there is nothing wrong with his decision letter the Governor, one of the Manpower Tanggerang in explaining the trade union side.

 

"Disnaker Tangerang City did not understand the structure of textile industry, where industry can not distinguish the fiber, spinning, weaving, knitting and garment up through letter no. 561/621-HI/2012 explained that our sector that produces fiber and yarn are included in UMSP so that the minimum wage of Rp. 1,682,065, -, whereas the decree of the governor was clearly stated that this applies only to UMSP weaving industry, the garment of knitting, garments of textiles, shoes and handbags are very clear difference "he explained.

 

"We have formally described in writing in City Manpower Tanggerang on this and ask them to explain again that guided by the Head of the Central Statistics Regulation Number 57 Year 2009 on the Standard Industrial Classification of Indonesia (KBLI) where there is described KBLI each type effort was clearly different "he added.

 

Redma regret to this day there is no response from the Department of Labor on issues that have been delivered almost 2 weeks ago this was. "The letter explained that the fiber industry and its filament KBLI 20 131, 20 301, 20 302 and 13 112, while the weaving industry KBLI 13 121, 13 122 and 13 123, 14 301 garments from knitted KBLI, textile garments of KBLI 14 301, 15 201 KBLI shoes, 15 202, 15 203 and 15 209 and 1512 and the bag, "he explained.

 

To solve this problem APSyFI bring the ministerial level. "We've mentioned this in writing to the Minister of Manpower and Transmigration and the Ministry of Industry and APINDO a few days ago, hopefully get a positive resolution without having to bring this issue into the realm of law" he explained.

 

Redma added that it is very important, because we often see the wrong officials misinterpret a policy or policies to the detriment of the business world. "In principle we as the business world for the sake of the national economy will always comply with all regulations set by the government, we only ask that the rules are applied according to the portions" he said.

 

 

Disnaker Kota Tanggerang Kurang Responsif, UMSP Bermasalah

 

Kisruh penentuan Upah Minimum Kabupaten 2012 (UMK 2012) di Provinsi Banten masih menyisakan masalah. Hal ini dikarenakan adanya Keputusan Gubernur Banten tentang Upah Minimum Sektoral Kota Tanggerang dan Kabupaten Tanggerang yang ditafsirkan secara keliru oleh Kepala Dinas Ketenagakerjaan Kota Tanggerang khususnya di sektor Tekstil dan Produk Tekstil (TPT).

 

Sebelumnya ditahun 2011 UMK Kota Tanggerang sebesar Rp. 1.290.000,- dan di tahun 2012 sesuai Keputusan Gubernur Banten Nomor 561/Kep.886-Huk/2011 tentang Penetapan Upah Minimum Kabupaten/Kota Se-Provinsi Banten Tahun 2012 ditetapkan bahwa UMK Kota Tanggerang sebesar Rp.1.381.000,-. Keputusan ini direvisi melalui Surat Keputusan Gubernur Banten Nomor 561/Kep.1-Huk/2012 tentang Perubahan Atas Keputusan Gubernur Banten Nomor 561/Kep.886-Huk/2011 tentang Penetapan Upah Minimum Kabupaten/Kota Se-Provinsi Banten Tahun 2012 sehingga UMK Kota Tanggerang menjadi Rp. 1.529.150,-. Setelah sempat terjadi penolakan oleh beberapa sektor usaha melalui Asosiasi Pengusaha Indonesia (APINDO) akhirnya semua pengusaha menyepakati untuk menerima UMK Kota Tanggerang sebesar Rp.1.529.150,-.

 

Namun dengan adanya Surat Keputusan Gubernur Banten Nomor 561/Kep-2-Huk/2012 tentang Upah Minimum Sektoral Kota Tanggerang dan Kabupaten Tanggerang maka ditetapkan upah minimum beberapa sektor yang lebih tinggi dari UMK Kota Tanggerang. Penolakan atas UMSP Kota Tanggerang dilakukan oleh Asosiasi Produsen Synthetic Fiber Indonesia (APSyFI) karena Surat Dinas Ketenagakerjaan Kota Tanggerang yang dinilai salah menjelaskan UMSP ini kepada pihak serikat pekerja sehingga menuntut upah minimum yang lebih tinggi.

 

Sekretaris Jenderal APSyFI, Redma Gita Wirawasta mengatakan bahwa tidak ada yang salah dengan surat keputusan Gubernur-nya, yang salah adalah Dinas Ketenagakerjaan Tanggerang dalam menjelaskannya pada pihak serikat pekerja.

 

“Dinas Ketenagakerjaan Kota Tanggerang tidak mengerti struktur industri TPT, tidak bisa bedakan mana industri serat, pemintalan, pertenunan, perajutan dan garment hingga melalui surat no. 561/621-HI/2012 dijelaskan bahwa sektor kami yang memproduksi serat dan benang termasuk dalam UMSP sehingga upah minimumnya sebesar Rp. 1.682.065,-, padahal dalam SK Gubernur-nya jelas tercantum bahwa UMSP ini berlaku hanya untuk industri pertenunan, garmen dari rajut, garmen dari tekstil, sepatu dan tas yang sangat jelas perbedaanya” jelasnya.

 

“Kami sudah jelaskan secara resmi tertulis pada Dinas Ketenagakerjaan Kota Tanggerang mengenai hal ini dan meminta mereka untuk menjelaskan ulang yang berpedoman pada Peraturan Kepala Badan Pusat Statistik  Nomor 57 Tahun 2009 tentang Klasifikasi Baku Lapangan Usaha Indonesia (KBLI) dimana disana dijelaskan KBLI masing-masing jenis usaha pun jelas berbeda” tambahnya.

 

Redma menyayangkan hingga saat ini tidak ada respon dari Dinas Ketenagakerjaan mengenai permasalahan yang sudah disampaikan hampir 2 minggu yang lalu ini. “Dalam surat itu dijelaskan bahwa industri serat dan filament KBLI-nya 20131, 20301, 20302 dan 13112, sedangkan KBLI industri pertenunan 13121, 13122 dan 13123, garmen dari rajut KBLI 14301, garmen dari tekstil KBLI 14301, sepatu KBLI 15201, 15202, 15203 dan 15209 serta dan tas 1512”, jelasnya.

 

Untuk menyelesaikannya APSyFI membawa permasalahan ini ke tingkat Menteri. “Kami sudah menyampaikan hal ini secara tertulis kepada Menteri Tenaga Kerja dan Transmigrasi dan Menteri Perindustrian dan APINDO beberapa hari yang lalu, mudah-mudahan mendapat penyelesaian yang positif tanpa harus membawa masalah ini ke ranah hukum” jelasnya.

 

Redma menambahkan bahwa hal ini sangat penting, karena kita sering melihat pejabat yang salah mengambil kebijakan atau salah menafsirkan kebijakan sehingga merugikan dunia usaha. “Pada prinsipnya kami sebagai dunia usaha demi kepentingan ekonomi nasional akan selalu mentaati semua peraturan yang ditetapkan pemerintah, hanya kami minta peraturan itu diterapkan sesuai porsinya” tegasnya.
