Government relaxes provisions non material import of hazardous and toxic waste. However, businesses assess the revision did not cover matters which have extended the import process. Last week, the Ministry of Commerce (Trade) released the Minister of Trade Regulation (Regulation) No. 31 / M-DAG / PER / 5/2016 dated May 9, 2016. Based on this rule importer of waste non-hazardous and toxic (B3) pocketed enough import approval ( PI).

 

In the previous rules, importer of non B3 waste must be acknowledged as an importer producers (IP), as stipulated in Decree No. 39 / M-DAG / PER / 9/2009. Meanwhile, in terms of the publishing process and requirements PI is more concise than the IP.

 

But to get the PI, the importer must still attach a recommendation from the Director General of Waste Management, Waste and B3 Ministry of Environment and Forests (KLHK) and of the Director General of Chemical Industry, Textile and Miscellaneous of the Ministry of Industry.

 

In addition, importers also still need to include a survey report (LHS) of surveyors already established Ministry of Industry and attach photographic evidence to indicate ownership of advanced waste treatment facilities.

 

In terms of number of recommendation, publishing PI require fewer recommendations than the IP. Even so, businesses assess precisely the recommendations and obligations of surveys that burden the import process.

 

YET COMPLETED

 

Vice Chairman of the Iron and Steel Industry Association of Indonesia (IISIA) Ismail Mandry said the association had proposed relaxation of the rules related to the import of raw materials.

 

"What we are proposing to be revised is the presence of impurities 2%, then eliminating the recommendations issued KLHK to better facilitate," he

 

Separately, Vice Chairman of Indonesian Pulp and Paper Association (APKI) Rusli Tan said it appreciates the government's efforts to relax the rule.

 

However, during these requirements given costly and automatically affect the cost of industrial production.

 

"There needs to be a reduction and elimination of costs that are not necessary. Other countries more efficient production. We expected each policy should reduce production costs in order to increase competitiveness. There need be no surveyor, "he said.

 

Meanwhile, in a regulation relating to import newest non B3 waste, the government asserts that one of the considerations the revision of these rules is to simplify licensing in order to encourage competitiveness.

 

While the earlier Regulation is considered to be irrelevant. Meanwhile, new rules came into effect 90 days after enactment.

 

Earlier, the Ministry of Trade also relax the rules for issuance of trade license (SIUP) and Company Registration (TDP) with trim the duration of the issuance of 3 days to 2 days.

 

Importir Cukup Memiliki Persetujuan Impor

 

Pemerintah merelaksasi ketentuan impor limbah nonbahan berbahaya dan beracun. Namun demikian, pelaku usaha menilai revisi tersebut belum mencakup hal-hal yang selama ini memperpanjang proses impor. Pekan lalu, Kementerian Perdagangan (Kemendag) merilis Peraturan Menteri Perdagangan (Permendag) No 31/M-DAG/ PER/ 5/2016 tertanggal 9 Mei 2016. Berdasarkan aturan tersebut importir limbah non bahan berbahaya dan beracun (B3) cukup mengantongi persetujuan impor (PI).

 

Dalam aturan sebelumnya, importir limbah non B3 harus memiliki pengakuan sebagai importir produsen (IP), seperti tertuang dalam Permendag No 39/M-DAG/PER/9/2009. Adapun, dari segi proses penerbitan dan persyaratannya PI lebih ringkas dibandingkan dengan IP.

 

Namun untuk mendapatkan PI, importir harus tetap melampirkan sejumlah rekomendasi dari Direktur Jenderal Pengelolaan Sampah, Limbah dan B3 Kementerian Lingkungan Hidup dan Kehutanan (KLHK) dan dari Dirjen Industri Kimia, Tekstil, dan Aneka Kementerian Perindustrian.

 

Selain itu, importir juga tetap harus menyertakan laporan hasil survei (LHS) dari surveyor yang sudah ditetapkan Kemenperin serta melampirkan bukti foto untuk menunjukkan kepemilikan fasilitas pengolahan limbah lanjutan.

 

Dilihat dari segi jumlah rekomendasi, penerbitan PI memerlukan rekomendasi yang lebih sedikit dibandingkan dengan IP. Meski begitu, pelaku usaha menilai justru rekomendasi dan kewajiban survei yang membebani proses impor tersebut.

 

BELUM MENYELESAIKAN

 

Wakil Ketua Asosiasi Industri Besi dan Baja Indonesia (IISIA) Ismail Mandry menuturkan pihak asosiasi pernah mengusulkan relaksasi terkait aturan impor bahan baku tersebut.

 

“Yang kami usulkan agar direvisi adalah adanya impurities 2%, kemudian menghilangkan rekomendasi yang dikeluarkan KLHK agar lebih mempermudah,” tuturnya

 

Secara terpisah, Wakil Ketua Umum Asosiasi Pulp dan Kertas Indonesia (APKI) Rusli Tan menyatakan pihaknya mengapresiasi upaya pemerintah untuk merelaksasi aturan tersebut.

 

Namun, selama ini persyaratan yang diberikan memakan biaya dan otomatis berpengaruh pada ongkos produksi industri.

 

“Perlu ada pengurangan dan penghapusan biaya-biaya yang tidak perlu. Negara lain produksinya lebih efisien. Yang kami harapkan setiap kebijakan semestinya mengurangi biaya produksi agar daya saing meningkat. Tidak perlu ada surveyor,” ungkapnya.

 

Sementara itu, dalam beleid teranyarnya terkait dengan impor limbah non B3 ini, pemerintah menegaskan bahwa salah satu pertimbangan revisi aturan tersebut adalah untuk menyederhanakan perizinan demi mendorong daya saing.

 

Sedangkan permendag sebelumnya dinilai sudah tidak relevan. Adapun, aturan terbaru ini berlaku mulai 90 hari sejak ditetapkan.

 

Sebelumnya, Kemendag juga merelaksasi aturan penerbitan Surat Izin Usaha Perdagangan (SIUP) dan Tanda Daftar Perusahaan (TDP) dengan memangkas durasi penerbitan dari 3 hari menjadi 2 hari.
