DG Customs Reveals Illegal Textile Smuggling PDF Print E-mail

Customs in collaboration with PPATK, Directorate General of Taxes, and Inspectorate General of the Ministry of Finance successfully dismantle export violations by the mode of notification of goods that are not in accordance with those notified in the Export Declaration of Goods (PEB). This violation was committed by PT SPL located in Bandung.

 

PT SPL exports goods in PEB with notification 4,038 cloth roll. On Wednesday (29/06/2016), based on information from Customs of West Java and the results of Tanjung Priok Customs Intelligence analysis, carried out the prosecution with the results of the examination only found 583 roll cloth.

From the results of this action, an investigation audit was conducted by Customs and conducted in collaboration with PPATK, Directorate General Tax (DJP), and the Inspectorate General of the Ministry of Finance.

 

The Company is charged with Article 103 letter a or Article 102 Sub-Article f of Law Number 17 Year 2006 concerning Amendment of Law Number 1O Year 1995 concerning Customs juncto Article 64 Paragraph (1) of the Criminal Code and Article 3 of Law Number 8 Year 2010 concerning Money Laundering Crime. Based on the results of the investigative audit, the potential state losses resulting from these violations are estimated to be approximately Rp118 billion. For this case, two suspects, FL and BS, have been seized and 16 seizures of banks, land and buildings, textile machinery, apartments and insurance policies have been made.

 

Do not stop there, Tanjung Priok Customs in cooperation with Tanjung Priok Resort Police, Customs Bandung and West Java Customs Office succeeded in thwarting the export of textile which is notified in the form of curtain, but after examined the officer found water in plastic which then wrapped Again with cloth and cardboard. Upon the officer's research, it was found that the three containers were owned by PT LHD, a Bonded Acceptance Company (KB) company located in Bandung area.

 

Sri Mulyani revealed that the successful export violation was not only an incorrect notification on the PEB document but also in the form of unloading or stockpiling of goods not in the designated place as PT WS located in Bogor.

 

On Saturday March 2, 2017, Customs officers succeeded in foiling five trucks of PT WS carrying textile and textile products (TPT) from KB, which were supposed to be exported, but instead dismantled at Pondok Gede, Bekasi. For this action, the company is charged under Article 102A letter d Law no. 10 of 1995 juncto Law no. 17 of 2006 for dismantling export goods within customs areas without the permission of Head of Customs Office juncto Article 55 of the Criminal Code.

 

One of the suspects with the initials KH was secured by the officers. Sri Mulyani explained, the illegal TPT action is not incessantly intensified. This is a series of prosecutions as the follow up of President Jokowi's directives to the Ministry of Finance, Bakamla, the Ministry of Commerce, the Ministry of Industry and the Police to prevent and combat the practice of smuggling used clothing as well as the illegal exports and imports of illegal TPT.

 

"This low enforcement is the President's instruction to protect import or export smuggling," he concluded.

 

 

 

Bea Cukai  Ungkap Penyelundupan Tekstil Ilegal

 

Bea Cukai bekerja sama dengan PPATK, Ditjen Pajak, dan lnspektorat Jenderal Kementerian Keuangan berhasil membongkar pelanggaran ekspor dengan modus pemberitahuan barang yang tidak sesuai dengan yang diberitahukan dalam Pemberitahuan Ekspor Barang (PEB). Pelanggaran ini dilakukan oleh PT SPL yang berlokasi di Bandung.

 

PT SPL melakukan ekspor barang dalam PEB dengan pemberitahuan 4.038 roll kain. Pada Rabu (29/06/2016), berdasarkan informasi dari Bea Cukai Jawa Barat dan hasil analisis intelijen Bea Cukai Tanjung Priok, dilakukan penindakan dengan hasil pemeriksaan hanya kedapatan 583 roll kain.

Dari hasil penindakan ini, dilakukan audit investigasi oleh Bea Cukai dan dilakukan pengembangan bekerja sama dengan PPATK, Direktorat Jendera| Pajak (DJP), dan lnspektorat Jenderal Kementerian Keuangan.

 

Perusahaan dijerat dengan Pasal 103 huruf a atau pasal 102 huruf f UU Nomor 17 Tahun 2006 tentang Perubahan Undang-Undang Nomor 1O Tahun 1995 tentang Kepabeanan juncto Pasal 64 Ayat (1) KUHP dan Pasal 3 UU Nomor 8 Tahun 2010 tentang Tindak Pidana Pencucian Uang. Berdasarkan hasil audit investigasi, potensi kerugian negara yang diakibatkan oleh pelanggaran ini diperkirakan kurang lebih sebesar Rp118 Miliar. Atas kasus ini, telah ditetapkan dua orang tersangka, yaitu FL dan BS, serta telah dilakukan penyitaan terhadap 16 rekening bank, tanah dan bangunan, mesin tekstil, apartemen, dan polis asuransi.

 

Tidak berhenti sampai di situ, Bea Cukai Tanjung Priok bekerja sama dengan Kepolisian Resort Tanjung Priok, Bea Cukai Bandung dan Kantor Wilayah Bea Cukai Jawa Barat berhasil menggagalkan upaya ekspor tekstil yang diberitahukan berupa curtain, namun setelah diperiksa petugas kedapatan berupa air dalam plastik yang kemudian dibungkus lagi dengan kain dan karton. Atas penelitian petugas, didapati bahwa ketiga kontainer tersebut adalah milik PT LHD, sebuah perusahaan penerima fasilitas Kawasan Berikat (KB) yang berada di wilayah Bandung.

 

Sri Mulyani mengungkapkan bahwa pelanggaran ekspor yang berhasil ditindak tidak hanya berupa pemberitahuan yang tidak benar pada dokumen PEB, namun juga berupa pembongkaran atau penimbunan barang tidak pada tempat yang ditentukan seperti yang dilakukan PT WS yang berlokasi di Bogor.

 

Pada Sabtu 2 Maret 2017, petugas Bea Cukai berhasil menggagalkan Iaju lima unit truk milik PT WS yang mengangkut barang tekstil dan produk tekstil (TPT) dari KB, yang seharusnya ditujukan untuk diekspor, namun malah dibongkar di Pondok Gede, Bekasi. Atas penindakan ini, perusahaan dijerat Pasal 102A huruf d UU No. 10 Tahun 1995 juncto UU No. 17 Tahun 2006 karena membongkar barang ekspor di dalam daerah pabean tanpa izin Kepala Kantor Pabean juncto Pasal 55 KUHP.

 

Salah seorang tersangka berinisial KH turut diamankan oleh petugas. Dijelaskan Sri Mulyani, penindakan terhadap TPT ilegal tidak henti-hentinya digencarkan. Hal ini merupakan rangkaian penindakan sebagai tindak Ianjut arahan Presiden Jokowi kepada Kementerian Keuangan, Bakamla, Kementerian Perdagangan, Kementerian Perindustrian, dan Kepolisian untuk mencegah dan memberantas praktik penyelundupan pakaian bekas serta ekspor dan impor TPT ilegal yang masih terjadi.

 

"Low enforcement ini adalah instruksi Presiden untuk lindungi penyelundupan impor ataupun ekspor," tutupnya.
