The struggle of PUK SPAI FSPMI PT Sinar Makin Mulya is getting worse. This is because the textile factory located in Cimahi city and established since 2001 declared it closed.

 

Approximately 275 workers are in danger of losing their jobs.

 

Prior to joining the Federation of Metal Workers Union of Indonesia (FSPMI), mid-2017, in this company there is already union. Nevertheless, for a dozen years, the existence of the union has no clarity. There is no record of the labor service. No Member Card (KTA SP / SB)

 

Since the establishment of PUK SPAI FSPMI, the board members and all members have conducted an intensive board meeting and consolidation meeting with all members. Activities of these routine activities get guidance from SPAI Branch Manager FSPMI Bandung Raya chaired by Hendrayana Hendri

 

Over a period of approximately 3 months; communication, discussion, consolidation, and training continue to be done. So that appears some points of alleged violation of employment rules that are done by the company.

 

In November 2017, PUK SPAI FSPMI PT SMM conducted a dialogue, lobbying, and negotiating with representatives of the company to discuss problems that exist in this textile factory. But these efforts did not result in an agreement.

 

Precisely on December 13, 2017 re-occur bipartite negotiations between the employee and the company that was attended directly by the owner of the company.

 

The negotiations are accompanied by a spontaneous reaction to stop production activities during negotiations. Also present in the company area of ​​PC devices, KC and solidarity of PUK Bandung FSPMI PUK, Disnaker Cimahi, Disnaker of West Java Province and local security apparatus.

 

Upon completion of the negotiations there is a decision of the company "referring to the meeting of 6 December 2017 between the employee's representative and the company's representative, the company hereby announce the result of the meeting on 6 December 2017 is as follows:

 

1. THR and pending salary will be paid on December 14, 2017 amounting to 50% of salary and delayed THR.

 

2. Employees work as usual until December 21, 2017 still get the usual salary separti (absent valid).

 

3. For employees who do not participate BPJS will be given policies in accordance with the ability of the company and paid after the factory sold or replace ownership.

 

4. The factory is declared closed on 22 dDDember 2017. Salaries and the remaining THR are paid on 22 December 2017.

 

5. Our party asks all employees together to keep the company until the factory is sold or replace ownership.

 

On Wednesday, December 20, 2017 at around 19:00 there is an indication made by the company by dismantling the machine production machine. So spontaneity reap the immediate reaction of the employees at that time also with coming to the company area, accompanied by PC, KC and solidarity board was also present at the location.

 

The security forces went down to maintain the condition in the field until the early hours.

 

In response to the conditions at the textile factory, the Consulates Branch of FSPMI Bandung Raya stated the attitude:

 

"Actually this condition is the worst condition experienced by friends of PT SMM workers. We can not remain silent to help this settlement. We have discussed with friends PUK management, PC there are some machines or items issued without the knowledge of PUK. Then we will withhold any outflow activity done by the company. "

 

Then we will encourage PUK friends to keep on making efforts by continuing to communicate with the device. Even if the bitterness of this company will close, we will still demand the rights of employees who have been ignored by the company.

 

"Although there is a debt of accounts receivable company with outsiders. We will keep the assets of the company's assets even if it must be sold then that should come first is the company's obligation to its employees, "said Chairman of KC FSPMI Bandung Raya, Jujun Juansah

 

 

Pabrik Tekstil di Cimahi Tutup

 

Perjuangan PUK SPAI FSPMI PT Sinar Makin Mulya makin berat. Hal ini, karena, pabrik tekstil yang terletak di kota Cimahi ini dan berdiri sejak tahun 2001 menyatakan tutup.

 

Kurang lebih 275 orang pekerja terancam kehilangan pekerjaan.

 

Sebelum bergabung dengan Federasi Serikat Pekerja Metal Indonesia (FSPMI), pertengahan tahun 2017, di perusaahaan ini sudah ada serikat pekerja. Namun demikian, selama belasan tahun, keberadaan serikat pekerjan tidak ada kejelasan. Tidak ada pencatatan dari dinas ketenagakerjaan. Tidak juga Kartu Tanda Anggota (KTA SP/SB)

 

Semenjak berdiri PUK SPAI FSPMI, para pengurus dan seluruh anggota secara instensif melaksanakan rapat rapat pengurus serta rapat konsolidasi dengan seluruh anggota. Kegiatan kegiatan rutin tersebut mendapatkan bimbingan dari Pimpinan Cabang SPAI FSPMI Bandung Raya yang diketuai oleh Hendrayana Hendri

 

Selama kurun waktu kurang lebih 3 bulan; komunikasi, diskusi, konsilidasi, dan pelatihan terus dilakukan. Sehingga munculah beberapa poin dugaan pelanggaran aturan ketenagakerjaan yang di lakukan oleh pihak perusahaan.

 

Pada bulan November 2017, PUK SPAI FSPMI PT SMM melakukan dialog, lobby, serta berunding dengan perwakilan pihak perusahaan untuk membahas permasalahaan permasalahan yang ada di pabrik tekstil ini. Namun upaya upaya tersebut tidak menghasilkan kesepakatan.

 

Tepatnya pada tanggal 13 Desember 2017 terjadi kembali perundingan bipartit antara pihak karyawan dengan pihak perusahaan yang dihadiri langsung oleh pemilik perusahaan.

 

Perundingan tersebut di sertai dengan reaksi spontanitas menghentikan aktifitas produksi selama perundingan berlangsung. Hadir pula di area perusahaan para perangkat PC, KC dan solidaritas dari PUK PUK FSPMI Bandung Raya, Disnaker Cimahi, Disnaker Provinsi Jawa Barat serta aparat keamanan setempat.

 

Setelah selesai perundingan di dapatlah suatu keputusan perusahaan “mengacu pada pertemuan tanggal 6 desember 2017 antara pihak perwakilan karyawan dengan pihak perwakilan perusahaan, maka perusahaan dengan ini menjawab hasil pertemuan pada tanggal 6 desember 2017 adalah sebagai berikut:

 

1. THR dan gaji yang tertunda akan dibayar pada tanggal 14 Desember 2017 sebesar 50% dari gaji dan THR yang tertunda.

 

2. Karyawan bekerja seperti biasa sampai dengan tanggal 21 Desember 2017 tetap mendapatkan gaji separti biasa (absen berlaku).

 

3. Bagi karyawan yang tidak ikut BPJS akan diberikan kebijakan sesuai dengan kemampuan perusahaan dan dibayarkan setelah pabrik terjual atau ganti kepemilikan.

 

4. Pabrik dinyatakan tutup pada tanggal 22 dlDesember 2017. Gaji dan sisa THR dibayarkan pada tanggal 22 desember 2017.

 

5. Kami pihak perusahaan meminta seluruh karyawan bersama sama menjaga perusahaan sampai pabrik terjual atau ganti kepemilikan.

 

Pada hari rabu 20 desember 2017 sekitar pukul 19.00 ada indikasi yang dilakukan oleh perusahaan dengan membongkar mesin mesin produksi. Sehingga spontanitas menuai reaksi langsung para karyawan pada saat itu juga dengan berdatangan ke area perusahaan, didampingi pengurus PC,KC dan solidaritas pun turut hadir di lokasi.

 

Aparat keamanan turun untuk menjaga kondusip di lapangan hingga dini hari.

 

Menyikapi kondisi di pabrik tekstil itu, Konsulat Cabang FSPMI Bandung Raya menyatakan sikap:

 

“Sebenarnya kondisi ini adalah kondisi terburuk yang dialami oleh teman teman pekerja PT SMM. Kita tidak bisa tinggal diam untuk membantu penyelesaian ini. Kita sudah berdiskusi dengan teman teman pengurus PUK, PC ternyata ada beberapa mesin atau barang-barang yang dikeluarkan tanpa sepengetahuan PUK. Maka kita akan menahan segala aktivitas keluar masuk yang dilakukan oleh pihak perusahaan.”

 

Kemudian kami akan mendorong teman teman PUK terus melakukan upaya upaya dengan terus berkomunikasi dengan perangkat. Kalaupun pahit-pahitnya perusahaan ini akan tutup, kita tetap akan menuntut hak-hak karyawan yang selama ini diabaikan oleh perusahaan.

 

“Meskipun ada utang piutang perusahaan dengan pihak luar. Kita akan menjaga aset aset perusahaan kalaupun itu harus dijual maka yang harus didahulukan adalah kewajiban perusahaan terhadap karyawannya,” kata Ketua KC FSPMI Bandung Raya, Jujun Juansah)
